1. Introduction
These Terms & Conditions (“Terms”) govern your purchase and use of AskQ, a software service provided by OrangeQuery LLC (“we,” “our,” “us”). By purchasing and using AskQ, you agree to these Terms.
2. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
3. Products and Subscriptions
Product Description: AskQ is an AI-powered enterprise analytics insight generation assistant that allows organizations to analyze automated data insights.
Subscriptions: Purchases are billed month to month unless otherwise stated at checkout. Pricing and billing frequency are clearly displayed at checkout.
Cancellation: You may cancel your subscription at any time via Paddle.com. Cancellation stops future billing from the next billing period.
4. Refund Policy
We offer a 30-day money-back guarantee from the date of purchase. After 30 days, refunds are not generally available except as required by law. To request a refund, contact support@orangequery.com with your order details.
5. Order Errors
If you believe you have made an error in your order, contact support@orangequery.com immediately. We will take reasonable steps to correct order errors before fulfillment.
6. Product Fulfillment
Upon successful payment, you will receive an email confirmation from Paddle.com including your receipt. OrangeQuery LLC will provide activation instructions, login details, or license information without delay. Access to AskQ is granted immediately after account and data integration setup.
7. Use of AskQ
You may use AskQ for lawful business purposes only. You agree not to engage in fraudulent, abusive, or deceptive practices when using the product. AskQ generates insights for informational purposes.
8. Complaints
We aim to resolve all complaints within 5 business days. If you are dissatisfied, you may contact Paddle.com directly or escalate to the relevant consumer protection authority in your jurisdiction.
9. Disputes and Chargebacks
Disputes and chargebacks are handled by Paddle.com as Merchant of Record. You agree to first contact OrangeQuery LLC or Paddle.com to resolve any issues before initiating a chargeback.
10. Liability
Disclaimer
The services and any insights, recommendations, analyses, visualizations, data, or content provided by OrangeQuery LLC (“AskQ”) are provided “as is” and “as available” and for general informational purposes only. OrangeQuery LLC makes no warranties, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of any content or insights.
No Professional Advice / No Reliance
Insights or outputs generated by AskQ are not a substitute for professional, legal, financial, medical, tax, safety, or other professional advice. Users must not act or refrain from acting on the basis of any insight without obtaining appropriate professional or expert advice.
Limitation of Liability
To the maximum extent permitted by applicable law, OrangeQuery LLC's aggregate liability for any claims arising out of or relating to these Terms or the Services shall not exceed the fees paid by you to OrangeQuery LLC for the Services giving rise to the claim in the twelve (12) months preceding the event giving rise to such claim.
Customer Responsibilities
You are solely responsible for verifying the suitability, accuracy, and completeness of any insight or output from the Services prior to relying on it.
Indemnity
To the extent permitted by law, you agree to indemnify, defend and hold harmless OrangeQuery LLC and its officers, directors, employees, agents and affiliates from and against claims arising out of your use of the Services or breach of these Terms.
Error Reporting and Limited Remedies
If you believe an insight is incorrect or causes harm, notify OrangeQuery LLC in writing at support@orangequery.com within thirty (30) days of discovery and provide supporting evidence.
Third-Party Data
The Services may use or rely on third-party data, models, or integrations. OrangeQuery LLC does not control such third parties and does not warrant the accuracy or completeness of third-party content.
11. Governing Law
These Terms are governed by the laws of the State of Ohio, USA. Any dispute arising in connection with these Terms shall be resolved in the courts of Ohio, United States.
12. Survival
Sections concerning disclaimers, limitation of liability, indemnity, customer responsibilities, and dispute resolution shall survive termination of these Terms.
